The first question in every rideshare case is which coverage period applies. Uber and Lyft both operate a tiered insurance structure tied to driver app activity at the time of the crash:
Period 0 (app off): The driver is a private individual using their personal auto insurance only. Uber and Lyft have no coverage obligation and no liability exposure under their corporate policy.
Period 1 (app on, waiting for a match): The driver is available but not yet matched with a rider. California requires Uber and Lyft to provide contingent liability coverage of $50,000/$100,000/$30,000 if the driver’s personal insurer denies coverage. This coverage gap is the most difficult scenario for injured claimants.
Period 2 (en route to pickup) and Period 3 (passenger on board): Once a driver accepts a ride and is heading to the passenger, or once the passenger is in the car, Uber and Lyft’s $1,000,000 commercial liability policy applies. This is the standard for passenger injury cases and provides the fullest available coverage.
Establishing which period applies requires obtaining the driver’s platform activity log. We request this information immediately after being retained and use it to build the coverage strategy for your case.
El Segundo’s border with LAX means that rideshare accidents involving drivers repositioning from or toward the airport, or accidents that occur on airport access roads, may implicate LAWA, the City of Los Angeles. LAX is operated by Los Angeles World Airports (LAWA), a city department. If your accident occurred on a roadway controlled by LAWA – including sections of World Way, the airport access roads, and certain portions of Sepulveda and Imperial adjacent to the airfield – a government tort claim against the City of Los Angeles may be required within six months of your injury under Government Code section 911.2.
Rideshare drivers who have just completed an airport drop or are repositioning for LAX pickups move through El Segundo constantly on Sepulveda and Imperial. These drivers are sometimes distracted by the Uber or Lyft app – looking for new ride requests, checking GPS routing, or reviewing app notifications. When a distracted rideshare driver causes an accident in or near El Segundo, the claim runs against the driver, through the applicable period’s insurance coverage, and potentially against the government entity if the road condition contributed.
Corporate campus commuter pickups. Workers at the Northrop Grumman, Boeing, Raytheon, and Aerospace Corporation campuses regularly use Uber and Lyft for their commutes. End-of-day pickups near campus exits on El Segundo Boulevard and Nash Street create a concentration of rideshare vehicles making abrupt stops during the afternoon rush. LAX repositioning traffic on Sepulveda. Rideshare drivers traveling between the LAX pickup zone and surrounding streets pass through El Segundo constantly. Sepulveda is the primary corridor for this movement. Drivers looking at their apps while moving through El Segundo are a documented source of distracted-driving accidents on this corridor.
Rideshare accidents near the Chevron refinery access roads. The Chevron refinery at El Segundo’s southwestern edge generates its own traffic. Rideshare pickups and dropoffs for refinery workers and contractors occur on the surrounding streets. The intersection of refinery truck traffic and rideshare vehicles on these access roads creates mixed-use hazards.
Downtown El Segundo rideshare stops. The Main Street downtown area has enough bar and restaurant activity to generate a moderate rideshare demand, particularly on weekends. Narrow downtown streets and limited curb space mean rideshare vehicles frequently stop in the travel lane, creating accident risk for following vehicles and cyclists.
Under California Code of Civil Procedure section 335.1, the two-year deadline applies to personal injury claims against private parties including rideshare drivers and the Uber/Lyft corporate entities. For accidents involving LAWA or Caltrans infrastructure, the six-month government tort claim deadline under Government Code section 911.2 applies and is the controlling deadline – it runs first and cannot be extended in most circumstances. What about Uber Eats and food delivery drivers in El Segundo? Delivery app drivers – Uber Eats, DoorDash, GrubHub – operate under different insurance structures than rideshare drivers. DoorDash and GrubHub maintain commercial policies when drivers are on active deliveries, but the coverage amounts and period definitions differ from Uber/Lyft rideshare.
