Hermosa Beach has several well-defined locations where pedestrian accident risk is elevated. Understanding which entity is responsible for each location matters enormously to how a claim is handled – because city-owned property triggers a government claim requirement that private-property incidents do not.
The Strand. The Strand is a multi-use path running the entire length of the Hermosa Beach waterfront and connecting to adjacent cities in both directions. It is owned and maintained by the City of Hermosa Beach. PCH crossings. Pacific Coast Highway is a state highway maintained by Caltrans. Pedestrians trying to reach the beach from east of PCH must cross a high-speed road that is not designed for foot traffic at all locations. Poorly marked crossings, long signal cycles, and drivers traveling at highway speeds make these crossings dangerous. If a deficient crossing design or signal failure contributed to your injury, the responsible government agency – the City or Caltrans – must be notified via a government tort claim within the applicable window.
Hermosa Avenue crosswalks. Hermosa Avenue has marked crosswalks at most intersections, but driver compliance with yielding to pedestrians in crosswalks is inconsistent. Evening and nighttime crossings are particularly risky due to reduced visibility. Parked cars and the proximity of beach access points create visibility obstructions at some intersections.
California Government Code section 911.2 requires an injured party to present a written tort claim to any public entity before filing a lawsuit against it. The deadline is six months from the date of injury.
